Paul J. Zidlicky, Partner PAUL J. ZIDLICKY is a partner in Sidley's Washington, D.C., office. His practice has been divided between complex civil litigation and appellate litigation. Mr. Zidlicky has represented a wide variety of clients, including telecommunications companies, financial institutions, manufacturers, pharmaceutical companies and transportation companies in federal and state courts and before federal regulatory agencies. He has argued before the United States Supreme Court and before federal courts of appeals and district courts. He has briefed numerous cases before the United States Supreme Court for petitioners and amici on issues including the Federal Arbitration Act, the Telecommunications Act of 1996, the Takings Clause of the Fifth Amendment, the First Amendment, and the admissibility of expert testimony under Rule 702 and Daubert. Representative cases before the Supreme Court include Green Tree v. Bazzle (2003), NCTA v. Gulf Power (2002); Green Tree v. Randolph (2001) and Kumho Tire Co. v. Carmichael (1999). In the federal courts of appeals, he has briefed and/or argued cases involving issues such as administrative law, civil RICO, the First Amendment, and products liability law. At the trial level, Mr. Zidlicky has significant experience acting as legal issues and motions counsel preparing high-profile cases for trial and for appeal. He has handled all legal and appellate aspects of trial litigation, including document retention orders, removal to federal court based upon fraudulent and egregious misjoinder, class certification, exclusion of expert testimony under Daubert and state-law analogs, exclusion of irrelevant and unfairly prejudicial evidence from the liability and punitive phases of trial, summary judgment and other dispositive motions. Mr. Zidlicky joined the firm following clerkships with Chief Justice William H. Rehnquist of the United States Supreme Court in Washington D.C. and Judge Frank J. Magill of the United States Court of Appeals for the Eighth Circuit in Fargo, N.D. He graduated with high honors from the George Washington University, National Law Center, where he served as Senior Managing Editor of the Law Review and was elected to the Order of the Coif.
